JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-12-2016 Heard the learned counsel for the petitioner and the learned A.P.P. representing the State.

The petitioner seeks anticipatory bail in connection with Keoti P.S. Case No. 59 of 2015 registered for the offences punishable under Sections 341, 323, 504 and 307/34 of the Indian Penal Code.

Allegedly, the petitioner and other F.I.R. named accused persons started abusing the informant and when she protested then they assaulted with lathi, danda and rod causing injury on her head and further, the informant fell down and became unconscious. The petitioner gave rod blow on her head causing head injury.

Submission is of false implication and that this case

Patna High Court Cr.Misc. No.47554 of 2016 (2) dt.14-12-2016 2/2 is counter blast of Keoti P.S. Case No. 58 of 2015. The informant received injury when she was trying to flee away after the committing the crime and she got injury by wooden gate of door of the petitioner and fell down. The injury caused to the informant was simple in nature vide Annexure 2/1 and, as such, the petitioner deserves sympathetic consideration. Learned A.P.P. after going through the injury report, fairly, submits that head injury caused is simple in nature and the case lodged by the informant of this case is counter blast.

In the facts and circumstances stated above, the petitioner in case of his arrest or surrender before the court below within one month from the date of receipt / production of a copy of this order shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Keoti P.S. Case No. 59 of 2015, subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
