The petitioner seeks bail in a case registered under Section 379/34 of the Indian Penal Code.

Prosecution case, in short is that the motorcycle, parked near Priya Clinic, was found missing.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 09-04-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case due to previous enmity. FIR has been instituted after a delay of eight days. Delay in lodging the FIR has not been explained. The other co-accused with similar allegation have been granted bail by a coordinate

Patna High Court CR. MISC. No.41165 of 2019(2) dt.05-07-2019 2/2 bench of this court vide order dated 20-06-2019 passed in Cr. Misc. No. 37656 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 229 of 2018.
