Petitioners apprehend their arrest in a case registered under sections 379 and 323/34 of the Indian Penal Code. Petitioners are not named in the first information report but in course of investigation, I.O collected some cogent materials against the petitioners. Moreover, it is case of theft and custodial interrogation of the petitioners is essential.

In the aforesaid circumstances, I am not inclined to extend the privilege of anticipatory bail to the petitioners and accordingly, their prayer for anticipatory bail petition in Katoira P.S. case no. 207/2015 pending in the court of the Addl. Chief Judicial Magistrate I, Banka/ concerned court is, hereby, rejected.
