The petitioners are apprehending his arrest in connection with Nanpur P.S.Case no.57/2019, registered for offences punishable under Sections 272, 273, 308 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioners is about recovery of 15 ltrs. of country-made liquor from behind the house of the petitioners.

Submission of the learned counsel for the petitioners is that they have no criminal antecedent and they have falsely been implicated in this case.

Patna High Court CR. MISC. No.42809 of 2019(2) dt.12-07-2019 2/2 On the other hand, learned APP has opposed the prayer for anticipatory bail on the ground that there is prima facie case against the petitioner, as such this application is not maintainable.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, pray for regular bail, which will be considered by the learned court below on its own merit and if possible to be disposed of on the same day.

With the aforesaid observation, this application is dismissed.
