The petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 12 of 2021 instituted for the offences under Sections 7(a) of the Prevention of Corruption Act, 1988.
It is a case where the learned counsel submits that the nothing was recovered from the petitioner and he has been falsely implicated in a case under Sections 7(a) of the Prevention of Corruption Act, 1988. He submits that the petitioner had initiated action against the informant of lodging a F.I.R. regarding his work. On coming to know the same, the informant has falsely lodged a complaint with Anti Corruption Bureau who have in a completely falsely case, sought to trap the petitioner but nothing was recovered from the petitioner. I have considered the submissions and find that complaint was filed by the informant whereafter the demand was verified and after demand was having been verified a trap
Patna High Court CR. MISC. No.52855 of 2021(2) dt.18-02-2022 2/2 was laid to get the petitioner who upon coming to know about the same and seeing the Constables who came to the place where he had taken Rs.10,000/- as bribe from the informant, the family members of the accused as well as the accused raised a false alarm shouting that thieves have come to his house resultantly local people assembled and they opposed the Vigilance team and in the said assault by the local people on the Vigilance team by lathi, danda and stone pelting, accused ran off and escaped throwing the said amount at the place itself. A video film has been prepared.
In view of above it is apparent that the petitioner has committed not only offence under Sections 7(a) of the Prevention of Corruption Act, 1988, but he tried to evade custody and also got the Vigilance team injured, in view thereof no case for anticipatory bail is made out.
This application is dismissed.
