This application is for grant of regular bail in connection with Bochahan P.S.Case no.120 of 2017 for the offences punishable under Sections 376(2)(1) of the Indian Penal Code.

Allegation against the petitioner is of committing rape upon five years old daughter of the informant. Submission of the learned counsel for the petitioner is that allegation has not been corroborated by the medical evidence and he has been falsely implicated in this case. The petitioner is in custody for four months.

Heard learned A.P.P. , who has opposed the prayer for bail.

Patna High Court Cr.Misc. No.49886 of 2017 (3) dt.09-11-2017 2/2 Having heard both sides and in view of facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial of the case.

With the aforesaid observation, this application is dismissed.
