JUSTICE MADHURESH PRASAD ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 147,148,149,295(A), 153(A), 504,506,427,448,379 and 336 of the Indian Penal Code.

The allegation is that 34 named persons and 250 unknown persons are alleged to have been disrupting the communal harmony and violence. Petitioner is amongst the named persons.

The petitioner's counsel submitted that he has falsely been implicated in this case though there is no specific allegation against him. On the basis of said occurrence he has been made accused in some other cases which has been mentioned in Para 3 of the bail petition and other co-accused have been granted bail in

Patna High Court Cr.Misc. No.987 of 2018 (2) dt.11-01-2018 Cr. Misc. 60160 of 2017 vide order dated 13.12.2017. The petitioner is in jail custody since 17.10.2017. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in Arwal P.S. Case No. 197 of 2017 subject to the conditions : (i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
