The petitioner is languishing in custody for the offence punishable under Sections 341, 323, 504, 506, 307/34/302 of the Indian Penal Code.
According to FIR, there is general and omnibus allegation of commission of assault by all the FIR named accused persons including the petitioner causing injury to Roshan Kumar and Anant Singh at the head, as a result whereof injured Roshan died.
Submission is that the doctor has found single head injury on the deceased as well as another injured. The petitioner has also sustained serious injury during the occurrence.
Patna High Court CR. MISC. No.39122 of 2020(4) dt.16-04-2021 2/2 Petitioner is in custody since 15.02.2020. Investigation of the case is already complete.
Since allegation is against four persons of commission of injury at the head and the doctor has found single injury as well as considering the completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Nalanda P.S. Case No.22 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
