2. The petitioner seeks bail in connection with Maniyari P.S. Case No. 338 of 2023 registered for the offence under Sections 414 of the I.P.C and Section 8/20(b)(ii)(B) of the N.D.P.S. Act and Sections 25(1-b)a, 26/35 of the Arms Act.

3. According to the prosecution, four persons are alleged to have been apprehended by the police including the petitioner having possession of 1.820 Kg. of Ganja and one country made pistol along with two live cartridges.

4. Learned counsel for the petitioner submitted that it is a third attempt for regular bail before this Court. In earlier order dated 26.02.2023 in Cr. Misc. No. 11482 of 2024 prayer for regular bail of the petitioner was rejected and Cr. Misc. No. 16.41 of 2025 was dismissed as withdrawn. It is further

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order, it appears that total 1.820 Kg. of Ganja is recovered from the possession of the petitioner. On perusal of the impugned order dated 14.05.2025 it appears that charges against the petitioner is not framed till now and petitioner is custody since 19.10.2023.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS I, Muzaffarpur in connection with Maniyari P.S. Case No. 338 of 2023.

8. However, petitioner is directed to present physically each and every dated fixed by the trial court till conclusion of the trial.
