The petitioner apprehends his arrest in Khagaria P.S. Case No. 501/2015, registered for the offences punishable under Sections 188, 447, 420, 467, 468, 471, 506 and 34 of the Indian Penal Code.
The informant named the petitioner along with other accused persons and alleged that his father Rohini Prasad Singh purchased land of Khata no. 29, Khesra no. 1457 area of 04 Kattha 10 Dhurs on 16.06.1988. Smt. Radha Devi and Smt. Urmila Devi purchased this land in the year 1983 from the landlord Shivjee Sah of village - Vidyadhar ward no. 06. Shivjee Sah by forgery executed sale deed of this land in favour of others. It is submitted that Upendra Prasad Gupta and Janardan
Patna High Court Cr.Misc. No.45588 of 2016 (2) dt.24-11-2016 2/2 Mahto the father of the petitioner conspired and got the land by virtue of forged and fabricated sale deeds.
It appears that the informant made allegation against Janardan Mahto. No specific allegation is made against the petitioner Arun Kumar who happens to be the son of Janardan Mahto. The dispute appears to be of civil nature and Second Appeal is filed in this court in which Janardan Mahto father of the petitioner is one of the respondents.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 501/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
