JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2019 This is an application for grant of anticipatory bail in connection with Siwan (Chainpur) P.S. Case No. 73 of 2019 disclosing offences under Sections 363 & 366A of the Indian Penal Code.

Prosecution story is of kidnapping the minor daughter of the informant by one Suraj Singh and the petitioners also named in the kidnapping by said Suraj Singh.

Submission of the learned counsel for the petitioners is that the statement of the girl under Section 164 of the Cr.P.C. which is Annexure 2 to this petition has been recorded, in which she has categorically stated that due to fear of his father, she went to the house of her uncle and she has not made any allegation against these petitioners and she has disclosed her age

Patna High Court CR. MISC. No.42660 of 2019(2) dt.10-07-2019 2/2 as 17 years. It has also been submitted that the petitioners are mother and grandmother of the accused Suraj Singh. Heard learned A.P.P. also.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M. IV, Siwan, in connection with Siwan (Chainpur) P.S. Case No. 73 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
