The petitioner has preferred this application for grant of regular bail in a case registered under section 394 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, the two accused persons on a motorcycle overtook the informant and snatched Rs. 4000/- in cash besides a mobile phone of the informant. It is further stated that on resistance shown by the informant, he was shot in his leg.

It is submitted by learned counsel for the petitioner that the FIR was registered against two unknown. The name of the petitioner transpired in course of investigation when allegedly the looted mobile was being used by the petitioner. It

Patna High Court CR. MISC. No.52893 of 2021(3) dt.06-04-2022 2/2 is submitted that the allegation of the looted mobile being used by the petitioner is false and concocted. The petitioner is in custody since 15.6.2021. The other co-accused Shyam Bihari has been enlarged on bail.

Having heard learned counsel for the parties and taking into consideration the facts of the case, grant of bail to co-accused and the petitioner having remained in custody for more than 9 months, the Court directs the petitioner to be enlarged on bail in connection with Dumariyaghat P.S. Case no. 7 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Motihari, East Champaran.
