The petitioner apprehends his arrest in Dumariya P.S. Case No. 65/2014, registered for the offences punishable under Sections 386, 34 of the Indian Penal Code and Section 17 of C.L.A. Act.
The informant alleged that one Vinod Marandi, the extremist, called him from his mobile no. 8873049319 and demanded extortion of Rs. 1,00,000/-. The petitioner asked the informant to give Rs. 5000/- so that he may settle the dispute. Learned counsel for the petitioner submits that the petitioner lodged a case for kidnapping of his sister Rina Kumari. Rina Kumari made statement under Section 164 Cr.P.C. and that is why the petitioner has falsely been implicated in the case.

No.46636 of 2016 (2) dt.02-12-2016 2/2 It appears that Rina Kumari made her statement under Section 164 Cr.P.C. on 25.08.2014 but the present case was lodged on 30.07.2014 much before the case lodged by the petitioner against the informant. The petitioner demanded money from the informant to settle the dispute and to compromise with the extremist, who demanded extortion.
Considering the nature of allegations made against the petitioner, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) Rakhi U T
