Mr. Md. Iftekhar Mahmoo ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 10-01-2022 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State through virtual mode.

The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

The petitioner apprehends his arrest in connection with Chapra Muffasil P.S. Case No. 287 of 2020 registered for offence punishable under sections 341, 323, 147, 148, 307 and 379 of the Indian Penal Code.

At the very outset, the learned counsel for the petitioner has submitted that due to mistake, some papers of another case has been annexed with the present petition. In this

Patna High Court CR. MISC. No.12249 of 2021(3) dt.10-01-2022 2/3 respect, a supplementary affidavit has been filed on behalf of the petitioner with unconditional apology.

As per FIR, when the informant was going by a motor cycle, five FIR named accused persons attempted to snatch his bag. The allegation against the petitioner is that he inflicted knife blow on the chest of the informant, which hit near his right eye.

The learned counsel for the petitioner has submitted that there is previous enmity between the parties. He has further submitted that the informant lives at Bishunpura in the house of his maternal grand-father and the accused persons reside there and they are co-villagers and dispute had taken place between the parties due to cricket match. He has also submitted that injuries sustained by the informant are simple in nature and as per paragraph no. 3 of this bail petition, the petitioner has no criminal antecedent.

Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Saran at

Patna High Court CR. MISC. No.12249 of 2021(3) dt.10-01-2022 3/3 Chapra in connection with Chapra Muffasil P.S. Case No. 287 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
