Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Gurua P.S. Case No. 515 of 2022 registered for the offence under Sections 379 of the Indian Penal Code and charge sheet has been submitted under Section 379/411 of the Indian Penal Code. As per the prosecution case, unknown criminals committed theft of motorcycle.

During investigation, the number plate of the motorcycle has been recovered on the statement of the petitioner.

Learned counsel for the petitioner submits that the petitioner has clean antecedent and he is in custody since 27.12.2022.

Patna High Court CR. MISC. No.45704 of 2023(2) dt.28-07-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sherghati, Gaya in connection with Gurua P.S. Case No. 515 of 2022. The petitioner will visit concerned Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
