Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
There is no eye witness of the occurrence of murder. However, suspicion is there against the petitioners and others to have committed the murder. The direct evidence is against Duro Devi @ Duriya Devi that she had taken the deceased to her house where murder was committed and dead body was thrown towards field side.
The case diary would also reveal that there is no substantial material against the petitioners save and except
Patna High Court Cr.Misc. No.3235 of 2018 (2) dt.17-01-2018 2/2 suspicion.
Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Murliganj Police Station Case No. 86 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
