JUSTICE BIRENDRA KUMAR ORAL ORDER 08-01-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are in custody in connection with Banmankhi P.S. Case No. 189 of 2017, a case under Sections 341, 342, 323, 364, 365, 379, 504, 506/34 of the Indian Penal Code. The allegation is that the petitioners and others induced the informant to go with them and, thereafter, they snatched the belongings of the informant as informant refused to carry the liquor for them. However, the informant managed to escape and lodged a case before the police.
The learned counsel for the petitioner submits that the petitioners have falsely been implicated in this case. There is no
Patna High Court Cr.Misc. No.58302 of 2017 (3) dt.08-01-2018 2/2 other witness of the occurrence and the petitioners are in custody since 28.08.2017.
Considering the matter of allegation and criminal antecedent, let the petitioners, above named, be released on bail after completion of six months in custody on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Banmankhi Police Station Case No. 189 of 2017 with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
