2. The petitioner seeks regular bail in connection with Jandaha P.S. Case No. 155 of 2025 registered for the offence under Sections 317(4), 317(5), 338, 336(3), 340(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the allegation against the petitioner is that he was riding a stolen motorcycle and he along with others is accused of attempting to snatch gold chain from a woman and on hulla, they have been caught and beaten by the public. On search, one country made pistol loaded with a cartridge and two bullets have been recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The

Patna High Court CR. MISC. No.42495 of 2025(4) dt.03-09-2025 2/2 petitioner is in custody since 13.04.2025. The learned counsel for the petitioner has further submits that the recovered country made pistol is a planted one.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-V, Vaishali at Hajipur/concerned Court below in connection with Jandaha P.S. Case No. 155 of 2025.

7. As a condition of this order, the petitioner, after being released on bail, is directed to mark his attendance at Mahnar Police Station on every Sunday of the month. Any default in marking the attendance will result in cancellation of bail bonds of the petitioner.

8. Accordingly, this application for regular bail stands allowed.
