Although the petitioner makes allegation against the Mukhiya of Gram Panchayat Karsaut in the district of Siwan charging him of absconding from the post since last 10 months and thus incurring the disqualification of Section 18(5) of the Bihar Panchayat Raj Act, 2006 (hereinafter referred to as 'the Act'), Mr. Manoj Kumar, counsel for the petitioner fairly admits that no such application has been filed by the petitioner for the purpose before the prescribed authority.
In the circumstances discussed, the writ petition is disposed of. The petitioner, if so advised, may espouse his cause by taking recourse to the forum available to him under 'the Act'. (Jyoti Saran, J) S.Sb/- U
