2. The petitioner apprehends arrest in connection with Gopalganj Town P.S. Case No. 654 of 2024, dated 10.09.2024, registered under Sections 126(2), 115(2), 318(4), 338, 336(3), 340(2), and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.The prosecution case is based on a written complaint made by the informant, who was married to Late Chandan Kumar. After his death due to cancer, it is alleged that LIC agent Sunil Kumar (petitioner) and her father-in-law Vindhyachal Prasad fraudulently changed the nominee of a LIC policy to grab the claim amount. They allegedly submitted a forged application at the LIC office on 04.08.2023 for changing

It is further alleged that informant was assaulted on 10.09.2024 by Vindhyachal Prasad, and others while going to the LIC office to file a complaint. They allegedly tore her clothes, snatched her motorcycle and LIC documents, and threatened to kill her.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner is an LIC agent. It is next submitted that pursuant to the complaint made by the informant, the Senior Branch Manager of LIC Office, Gopalganj, conducted an inquiry in which the petitioner was issued a notice. In response, the petitioner submitted his show cause. Upon completion of the inquiry, the LIC management did not find any fault on the part of the petitioner. As regards the allegations of assault and snatching of LIC documents, the same have been levelled against her father-in-law, namely Vindhyachal Prasad. There is no allegation of assault or snatching LIC documents or the motorcycle has been made against the petitioner. Lastly, it is submitted that the petitioner has no criminal antecedents.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Gopalganj, in Gopalganj Town P. S. Case No. 654 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.
7. The application stands allowed.
