The petitioner is in custody since 01.05.2017 in connection with Barachattee P.S. Case No. 221 of 2017 for the offence registered under Sections 3, 4 and 5 of the Explosive Act and Section 17 of the C.L.A. Act.
Learned counsel for the petitioner submits the entire allegation is false and mischievous and only to harass the petitioner. It is further submitted that the petitioner is a simple farmer and has nothing to do with the recovered articles. It is further submitted that there is no recovery from his possession though mischievous seizure list was prepared but battery and detonator which were alleged to have been recovered could not be treated as explosive substances so as to attract the provisions of the Explosive Substances Act.
Patna High Court Cr.Misc. No.59067 of 2017 (2) dt.18-12-2017 2/2 Considering the period of custody and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Sherghati, Gaya in connection with Barachattee P.S. Case No. 221 of 2017.
