18-01-2016 Heard Md. Anis Akhtar, learned counsel for the petitioner and Sri Sanjay Kumar Giri, learned counsel, who has appeared on behalf of respondent/North Bihar Power Distribution Co. Ltd.
Earlier time was granted for filing counter affidavit on 30-10-2015, which has not been filed, however; Sri Giri submits that due to inadvertence, he failed to note the said direction and as

The petitioner, who is a commercial consumer of the electricity, has approached this Court with a prayer to direct the respondents to restore the three phase electric non-domestic supply (NDS-II) connection to the petitioner's premises i.e. an Industrial Training Centre. It has also been prayed to direct the respondents to correct the energy bill of the petitioner. Learned counsel for the petitioner submits that without any notice, the electric supply of the petitioner has been disconnected and an exaggerated energy bill has been raised. The petitioner thereafter filed several representations disputing the bill amount, however; neither any decision has been taken on his representation nor electric connection has been restored. Sri Giri, learned counsel for the respondent no. 5 again makes a prayer for adjourning the case for filing counter affidavit.
However, keeping in view the fact that the writ petition was filed in the year 2013 after serving copy on the concerned respondent and the fact that once adjournment was granted, it would not be appropriate to grant further time in a case where electric supply has been disconnected and as such, the Court proposes to dispose of the present writ petition with an
Patna High Court CWJC No.23985 of 2013 (3) dt.18-01-2016 3/3 observation that if the petitioner deposits the disputed bill amount i.e. Rs. 1,36,980.31/- (Rupees one lac thirty six thousand nine hundred eighty & paise thirty one) before the authority concerned and files fresh representation in respect of dispute of the enhanced bill, the respondent particularly respondent no. 6/Executive Engineer (Electrical), Electric Supply Division, Raxaul (East Champaran) immediately within two days of the deposit of the disputed bill amount shall restore the electric connection of the petitioner's premises and thereafter, he will thoroughly examine the representation of the petitioner and decide the dispute within a period of four weeks thereafter, failing which, the amount of disputed bill shall be adjusted in future energy bill of the petitioner.
The writ petition, with above observation and direction, stands disposed of.
