IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Revision No.610 of 2013 Arising Out of PS.Case No. 86 Year- 1999 Thana Noorsarai, District- NALANDA (BIHARSHARIFF) =========================================================== Rajeev Ranjan @ Pinku @ Rajiv Kumar Bharti represented through his father & natural guardian Nawak Kishore Prasad, resident of village Jalalpur, P.S. Noorsarai, Distt. Nalanda.

.... .... Petitioner/s

Versus

The State of Bihar .... .... Respondent/s =========================================================== Appearance :

For the Petitioner/s : Mr. Raj Kishore Pd., Adv. Mr. Tej Bahadur Ray, Adv.

For the State : Mr. R.B. Roy 'Raman', A.P.P. =========================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL JUDGMENT Date: 19-01-2016 Heard learned counsel for the Petitioner and the State. The Petitioner seeks revision of the order dated 27.4.2013 passed by the Additional District & Sessions Judge-I, Nalanda, Biharsharif, in Sessions Trial No. 308 of 2002. I find from the impugned order dated 27.4.2013 passed by the Additional District & Sessions Judge-I, Nalanda, Biharsharif, in Sessions Trial No. 308 of 2000 that it was at a very belated stage, the Petitioner filed a claim for being a juvenile and previously, the Petitioner had already been refused such a prayer after due enquiry. The impugned order reveals the case was pending for hearing since 2.7.2012 and for the next more than two years, it was not heard.

Patna High Court CR. REV. No.610 of 2013 dt.19-01-2016 2/2 I am surprised at the attitude of the Trial Judge who did not think it serious to dispose off the Trial for 2 years. The application stands rejected without further indulgence. (Anjana Prakash, J) S.Ali/- U T
