The petitioners seek pre-arrest bail in connection with Dhaka P.S. Case No.212 of 2015 registered under Sections 420 and 406/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that even if the entire allegations made in the FIR are taken to be true, no cognizable offence would be made out. No body appears on behalf of the State to oppose the prayer made by the petitioners.

Considering the nature of allegation, in the event of arrest or surrender before the court below within six weeks from

Patna High Court Cr.Misc. No.58862 of 2017 (2) dt.13-12-2017 2/2 today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Dhaka P.S. Case No.212 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
