JUSTICE ANIL KUMAR SINHA ORAL ORDER 10-02-2021 Heard Mr. Udit Narain Singh, learned Counsel for the petitioner and Mr. Surendra Prasad Singh, learned Additional Public Prosecutor for the State.

This application, for grant of regular bail, arises out of Saraiya Police Station Case No. 93 of 2020, disclosing offences under Sections 341, 323, 324, 307, 498(A), 504 and 506/34 of the Indian Penal Code.

The allegation, as per the First Information Report is that the marriage of the informant was solemnized with petitioner in the year 2006 and out of the said wedlock, one male child was born and subsequently, the petitioner performed second marriage and started torturing physically as well as

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to oblique motive inasmuch as the informant has voluntarily left the house of petitioner and she is residing in her parental house and earlier also the similar allegation was levelled against the petitioner in which the petitioner was granted bail and in the present matter the petitioner is in custody from 14.02.2020, i.e., about a year. Having regard to the submissions made by the parties and taking into consideration the materials on record and the nature of allegation and the fact that the petitioner is in custody since 14.02.2020, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, Karn Ram@ Dukhan Ram @ Karan Ram, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist (West)- cum-Sub-Judge, Muzaffarpur, in connection with Saraiya Police Station Case No. 93 of 2020.
