JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 17-11-2021 Learned counsel for the petitioner undertakes to remove all the defects pointed out by the Stamp Reporter within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. This is the third attempt of the petitioner to obtain bail in connection with Bhaptiyahi P.S. Case No. 67 of 2018 registered for the offences punishable under Sections 120(B), 302/34 of the Indian Penal Code.

The reasons and rational for not allowing the privilege of bail to the petitioner are indicated in the previous orders of this Court which are enclosed with the present petition. This petitioner happens to be an assailant.

Learned counsel for the informant has informed this

Patna High Court CR. MISC. No.54909 of 2021(2) dt.17-11-2021 2/2 Court that by this time all the prosecution witnesses have been examined and the trial itself has come to a fag end. Learned counsel for the petitioner, however, submits that he does not have this categorical information.

Be that as it may, considering the gravity of the offence alleged and that the trial itself is at the fag end and further considering that since passing of the last order on 03.03.2021 the pandemic situations were such that the courts were not properly functioning, this Court is not inclined to release the petitioner on bail at this stage. The learned trial court is expected to conclude the trial in terms of the observations of this Court in the order dated 03.03.2021 passed in Cr. Misc. No. 38247 of 2020 as early as possible and within a period of four months from the date of communication of this order.
