The petitioner seeks bail in Bakhtiyarpur P.S. Case No. 24/2018, instituted for the offences under Sections 379 and 411 of the Indian Penal Code.

It is alleged in the written report that the informant parked his motorcycle at Bakhtiyarpur Railway Station and went at platform to receive his relative. When he came back, he saw 3-4 boys are pushing his motorcycle. Police arrested one of them, who disclosed his name as petitioner. The other accused persons managed to run away.

Learned counsel for the petitioner has submitted that from the F.I.R., it is evident that while the miscreants were trying

Patna High Court Cr.Misc. No.58396 of 2018 (3) dt.01-11-2018 2/2 to steal the motorcycle, the petitioner was apprehended on chase. He has been apprehended merely on suspicion. He is in custody since 14.03.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Railway, Patna in connection with Bakhtiyarpur Rail P.S. Case No. 24/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
