2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a), ( d ) of Bihar Prohibition and Excise Act and sections 272, 273 and 34 of the Indian Penal Code .
3 . As per prosecution case , total 14 liters of was recovered from the house of different co-accused persons.
4. Learned counsel for the petitioner submits that the name of the petitioner transpired on the confessional statement of other co-accused persons and no incriminating material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. 5 . Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.42202 of 2025(2) dt.04-08-2025 2/2 bail.
6. Considering the facts of the case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional sessions Judge II cum special Judge Excise Madhubani in connection with Arer Police Station Case No. 15 of 2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
