2. Learned counsel for the petitioner, under instruction, seeks permission to withdraw the present petition with a view to file appeal before the appellate authority. It is further submitted that he will prefer the appeal within a period of one week from today before the appellate authority.

3. Permission for withdrawal of petition, as prayed for, is granted.

4. The writ petition stands disposed of as withdrawn.

5. If the petitioner files an appeal before the appellate authority within a period of one week from today, the concerned appellate authority shall decide the same, in accordance with law, within a period of four weeks from the date of receipt of the appeal.

6. It is clarified that we have not examined the merits
