JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

400 litres of kerosene oil was seized from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is not the PDS dealer. Hence, there is no question of violation of any control order, but maliciously the case has been lodged under Section 7 of the Essential Commodities Act against the petitioner.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with

Patna High Court Cr.Misc. No.49634 of 2015 (2) dt.05-11-2015 2/2 Khizer Sarai P.S. Case No. 249 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Gaya. With the observations above, the application stands disposed off.
