Versus
1. The State of Bihar.
2. Punam Kumari wife of Pankaj Sah and daughter of Parshuram Sah Resident of village - Bhadihan, P.S. Nanpur, District - Sitamarhi. .... .... Opposite Parties ====================================================== Appearance :
For the Petitioner/s : Mr. Pushpendra Kumar Singh For the Opposite Party/s : Mr. Ramchandra Sahani ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 2.
10-11-2016 The petitioner, husband of the complainant/opposite party no. 2, has approached this Court for grant of anticipatory bail, on the plea that falsely the petitioner has been made accused. Sri Ramchandra Sahani, learned Addl. Public Prosecutor has opposed the prayer for bail.
I have also perused the materials on record, particularly; the impugned order, from where, it is evident that before the learned Sessions Judge, at the time of hearing anticipatory bail petition, the complainant and petitioner had appeared and in presence of court, the wife/complainant had alleged that petitioner had solemnized second marriage, which was admitted by the petitioner.
Patna High Court Cr.Misc. No.44184 of 2016 (2) dt.10-11-2016 2/2 In view of facts and circumstances, there is no reason to extend the privilege of anticipatory bail. Dismissed.
