JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Surajpura P.S. Case No. 79 of 2017 registered under Sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Husband of the informant is said to have been eliminated by three named accused persons including the petitioner.

It is submitted by the learned counsel for the petitioner that petitioner has no concern with the aforesaid occurrence. Though the informant and brothers of the deceased, namely, Ashok Kumar and Pintu Kumar have stated in paragraphs 2, 3, and 4 respectively of the case diary that petitioner along with

No.51267 of 2017 (3) dt.20-12-2017 2/2 one Sandhya Devi was seen with the deceased at the time of occurrence and after occurrence, he escaped but said witnesses have not disclosed the source of getting information. Though Sandhya Devi was apprehended by the villagers but her statement was not recorded by the police. There is no cogent material indicating the complicity of the petitioner in the occurrence. He has been falsely implicated in the case merely on suspicion. Petitioner is languishing in custody since 23.06.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Bikramganj, Rohtas in connection with Surajpura P.S. Case No. 79 of 2017.
