2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, five named accused persons including the petitioner came to the tea stall where the informant was taking tea and the petitioner and other co-accused persons fired shot on the informant which hit on his chest and he became seriously injured.
4. It is submitted that there is no specific allegation of any overt act is alleged against this petitioner. It was coaccused Sonu Kumar who shot fire on the informant. He was

5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, 1st. Khagaria in connection with Parbatta (Maraiya) P.S. case no . 504 of 2021 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
