JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-12-2015 The petitioner apprehends his arrest in a case under sections 21 and 22 of the NPDS Act.
Three persons were apprehended from Bolero Jeep from which 45 kilograms of Ganja was recovered. Apprehended persons stated that they indulged in this business along with this petitioner who is the owner of the Jeep.
Learned counsel for the petitioner submits that he is simply a transporter and runs many vehicles and has been wrongly named by the accused persons.
In my view, if the petitioner surrenders and prays for regular bail in Jandaha Police station Case No. 145 of 2015, the same would be disposed of preferably on the same day on its own merit without prejudice, also taking into consideration that he is simply a transporter and runs many vehicles and has been wrongly named by the accused persons.
The bail petition is thus disposed of.
