The petitioner, in the present case, is seeking regular bail in connection with Bagha (Patkhouli) P.S. Case No.488 of 2016, registered for offences alleged under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present petitioner is the Mausera brother of the husband of the deceased. His name is not there in the fardbeyan of the informant, but in course of investigation on the basis of confessional statement of the husband of the deceased this petitioner has also been implicated. Learned counsel further submits that earlier a

Patna High Court Cr.Misc. No.2824 of 2018 (2) dt.17-01-2018 coordinate Bench of this Court has granted regular bail to the Mama (mother's brother) vide order dated 03.07.2017 passed in Cr.Misc.No.27831 of 2017.

Learned APP opposed the prayer for bail.

Considering the facts and circumstances as also the relationship of the petitioner with the deceased, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Bagaha, West Champaran in connection with Bagaha (Patkhauli) P.S. Case No.488 of 2016, subject to the conditions U/S 437(3) Cr.P.C.
