The petitioner apprehends his arrest in Masaurhi P.S. Case No. 109/2016, registered for the offences punishable under Sections 47(A) of the Excise Act.

On information the police raided a place and arrested one Chandra Shekhar Yadav and from his possession some country made liquor was recovered. It is alleged that near the land of the petitioner one hut was found and from which 35 litres country made liquor was recovered.

It is submitted that nobody named the petitioner, nor it is alleged that the petitioner was manufacturing any country made liquor. The hut was at lonely place and the petitioner was not arrested from the place.

No.39736 of 2016 (3) dt.17-11-2016 2/2 Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Masaurhi, Patna in connection with Masaurhi P.S. Case No. 109/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
