JUSTICE V.N. SINHA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner, the State and the counsel for the informant.

Petitioner is the husband of the deceased. He is apprehending his arrest in connection with a case registered for the offences under Sections 302, 201/34 of the Penal Code. He has been named in the First Information Report lodged by his fatherin-law as the assailant of his wife along with his parents. It is submitted on behalf of the petitioner that his father-in-law, the informant of the case, has derived the information about the occurrence from his three grandsons who were present in the house at the time of occurrence and named the petitioner and others as the assailant of his daughter. It is

Patna High Court Cr.Misc. No.41474 of 2015 (2) dt.15-10-2015 2/2 submitted that the statement of the three grandsons of the informant is recorded in paragraphs 26 to 28 of the case diary. Perusal whereof would indicate that they have categorically stated that the petitioner was not present in the house at the time of occurrence.

Let petitioner surrender in the court of Chief Judicial Magistrate, Madhubani in Pandaul P.S. Case No. 148/14 within a period of four weeks from the date of receipt/ production of a copy of this order in the court below and apply for regular bail, which should be considered in the light of the statement of his three sons recorded in paragraphs 26 to 28 in the case diary. Until such consideration no coercive steps be taken against the petitioner, but in any case, final order be passed within a period of four weeks from the date of surrender of the petitioner. The petition is, accordingly, disposed of.
