The petitioner seeks bail in (Manua Pul) Bettiah Muffasil P.S. Case No. 269 of 2017 registered under Section 414/34 of the Indian Penal Code and Sections 47, 48, 49, 50 and 96 of the Transport Animal Act.
The petitioner along with other accused persons are said to have been smuggling cattle on pick up van to Nepal and four cattle were recovered from the said vehicle and the petitioner was apprehended.
It is submitted by learned counsel for the petitioner that the petitioner happens to be the driver of the aforesaid vehicle. He has no concern with the said cattle as he was plying the said
Patna High Court Cr.Misc. No.50308 of 2017 (2) dt.18-10-2017 2/2 vehicle on the instruction of his owner. The petitioner has been languishing in custody since 29.06.2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with (Manua Pul) Bettiah Muffashil P.S. Case No. 269 of 2017 (Prakash Chandra Jaiswal, J) Mishra/- U T
