Patna High Court CR. MISC. No.1845 of 2021(2) dt.15-07-2021 2/3 15-07-2021 Heard Mr. Pritish Kumar Lal, the learned Advocate for the petitioners and Mr. Ram Priya Sharan Singh, the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Hulasganj (Hulashganj) P.S. Case No. 113 of 2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 325, 326, 307, 379, 420, 411 and 353 of the Indian Penal Code.

As the prosecution case stands, when the police party had arrived at a place on the information that sand is being loaded in several tractors, the accused persons also assembled and managed to extricate the seized tractors with bricks in their hands.

It has been submitted on behalf of the petitioners that they have been named by the local Chowkidar and have been identified by their sketches provided to the police party. It has further been submitted that the petitioners are agriculturists and it could be possible that they would have been present at their fields when they were wrongly identified by the police in the fractious mob which managed

The petitioners do not have criminal antecedents and have got no concern at all with the tractors which were seized but were taken away from the custody of the police. Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Jehanabad in connection with Hulasganj (Hulashganj) P.S. Case No. 113 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
