The petitioner apprehends his arrest in connection with Nasriganj P.S. Case no. 196 of 2016, registered under Section 379 of the Indian Penal Code.
The accusation is that in the night of 09-10.05.2016, she buffalo, which was tied in front of house of the informant was stolen. In course of search, the informant came to know that she buffalo has been stolen by four persons named in the F.I.R. including the petitioner.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that she buffalo of the informant was stolen in the night of 9/10-05.2016 and he lodged the present case after five months on 13.10.2016 mere on suspicion against four persons,
Patna High Court Cr.Misc. No.56907 of 2017 (2) dt.07-12-2017 2/2 including the petitioner. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bikramganj, Rohtas at Sasaram in connection with Nasriganj P.S. Case No. 196 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
