JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 147, 148, 149, 188, 341, 323, 333, 337, 353 and 307 of the Indian Penal Code. Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that though petitioner along with a large number of people had assaulted police personnels by pelting stones but no specific allegation has been attributed against the petitioner. It is further submitted that co-accused having similar allegation have already been granted anticipatory bail vide order dated 28.11.2016 in Cr. Misc. no. 45618 of 2016 and Cr. Misc. no. 45934 of 2016. Heard learned A.P.P. also.

Having heard both the parties and in view of the fact

Patna High Court Cr.Misc. No.48169 of 2016 (3) dt.10-01-2017 2/2 stated above that similarly situated co-accused have been granted anticipatory bail by a Bench of this Court, let above named petitioner, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Madhepura, in connection with Gamharia P.S. Case no.88 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
