The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

120 liters of illicit liquor has been recovered from a scooty and this petitioner has been made accused, since he is registered owner of said scooty.

It is submitted by learned counsel for the petitioner that scooty in question was stolen way back in the month of October, 2021, for which, an F.I.R., vide Jakkanpur P.S. Case No. 513/2021, was lodged and present F.I.R. has been lodged on 13.04.2022 in Alamganj police station, Patna for transportation of illicit liquor by the said scooty and as such, this petitioner cannot be held responsible for the alleged recovery. Petitioner has got clean antecedent.

No.43793 of 2022(2) dt.14-10-2022 2/2 Considering the aforesaid facts and circumstances as well as clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Patna City, Patna in connection with Alamganj P.S. Case No. 309 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
