JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 08-03-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Sasaram (Nagar) P.S. Case No. 04 of 2016 for the offences punishable under sections 147, 148, 149, 341, 323, 324 and 307 of the I.P.C. Allegedly, the petitioners and others being armed with iron-rod, knife and other weapons attacked upon the informant and started assaulting him resulting he fell down and then the petitioners gave knife blow in his chest and others assaulted also resulting the informant was brought at the Sadar Hospital Sasaram and the doctor referred to New Jagriti Hospital and Research
Patna High Court Cr.Misc. No.1672 of 2017 (5) dt.08-03-2017 2/2 Centre, Varanashi. The occurrence is of 28.11.2015 but no FIR was lodged and then on 23.12.2015 the FIR was lodged. Submission is of false implication and that there is case and counter case, the petitioners were also injured in the firing made by the informant, the arms was also produced and the present case is the counter blast of that case, the petitioners have filed case on 28.11.2015 itself and in the case diary there is no injury report as the injured has not produced the injury report of Varanashi.
In the facts and circumstances as stated above, considering that there is case and counter case and this case is the counter blast and further the case has been lodged on 23.12.2015 for the occurrence of 28.11.2015 and as such the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Rohtas in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
