JUSTICE ARUN KUMAR ORAL ORDER 16-02-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody, seeks bail in Balia PS Case No. 119 of 2017 registered under Sections 302 and 120B/34 of the IPC.

The allegation in brief is that the informant's son was found in unconscious state by side of the road, he was taken to hospital but expired and suspicion is raised against the FIR named accused persons as the deceased used to protest the accused persons who were engaged in prostitution and selling illicit liquor. Learned Counsel for the petitioner submits that except suspicion raised against the petitioner there is no other material and some of the co-accused similarly situated were admitted to anticipatory bail by a coordinate Bench of this Court. Having considered the said facts and circumstances, the petitioner, namely, K. B. Khalifa @ Ajay Khalifa is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Begusarai in connection with Balia PS Case No. 119 of 2017.
