JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 09-11-2015 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Ara Nawada P. S. Case No. 326 of 2015 registered under Sections 420, 468 and 471 of the Indian Penal Code.
It is contended that from the FIR itself it would transpire that the informant got information that his son Mantu Kumar had executed the sale deed in favour of one Rabindra Paswan. It is further contended that that even if the entire allegations are taken to be true, no offence as against the petitioners would be made out. Learned counsel for the State has opposed the
Patna High Court Cr.Misc. No.51804 of 2015 (2) dt.09-11-2015 2/2 application filed on behalf of the petitioners. He submits that the petitioners and Rabindra Paswan fraudulently got a sale deed executed by the son of the informant.
Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in Ara Nawada P. S. Case No. 326 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
