Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Alamnagar P.S. Case No. 109 of 2020 registered for the offence under Sections 302 and 120(B) of the Indian Penal Code.

The accused/petitioner is named in the F.I.R. and is in custody since 11.02.2022.

The allegation against the petitioner is to commit murder of husband of the informant, alongwith other co-accused persons due to previous land disputes by causing fire arm injuries. Learned counsel appearing on behalf of the petitioner submitted that the name of petitioner surfaced in this case, apparently, on the basis of suspicion arises out of land disputes, where informant is not the eye witness of the occurrence. Patna High Court CR. MISC. No.44499 of 2022(2) dt.08-12-2022 2/2 granted bail by one of the learned Co-ordinate Bench of this Court through Cr. Misc. No. 4341 of 2021 vide order dated 22.03.2021. While concluding the argument, it has been submitted that investigation has been completed, for which, charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

Learned APP informant is not the eye witness of the occurrence.

Considering the facts and circumstances as mentioned above, as save and except suspicion, nothing surfaced during the course of investigation, which may connect this petitioner with present set of occurrence/murder coupled with the fact that chargesheet has been submitted, where petitioner is in custody since 11.02.2022, let the petitioner, above named, is directed to be released on bail in connection with Alamnagar P.S. Case No. 109 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st Class, Udakishunganj, Madhepura/concerned court, subject to the conditions as mentioned under Section 437 (3) of the Cr.P.C.
