JUSTICE ALOK KUMAR SINHA ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 10-10-2025 RE: CWJC No. 9915 of 2024 In the instant petition, petitioner has prayed for the following relief(s):- "(i) For issuance of an order(s)/ direction(s) or writ(s) in the nature of writ of Mandamus as well as Prohibition for directing the concerned Respor dents to make such plans/ policies by which the series of demolishing bridges in the state of Bihar can be stopped and the hard earned money of the citizens can be protected from being wasted. And/or (ii) For issuance of further order(s) / direction(s) or writ(s) in the nature of writ of Mandamus directing the Respondents to blacklist all such construction companies (like Respondent No.

5) whose services were not found adequate & proper because of which the bridges & roads constructed by them got collapsed in the past. And/or (iii) For issuance of further order(s) / direction(s) or writ(s) in the nature of Prohibition for the sake of prohibiting Respondent No. 5 and all other such dark history having companies from constructing any further bridge in the state of Bihar and their participation in any further bid/ tender against any construction work in the upcoming future.

And/or (iv) For issuance of further order(s) / direction(s) or writ(s) in the nature of Certiorari for imposing huge costs upon the Respondents concerned

3/4 because of whose loose approach the bridges got collapsed in the state of Bihar and also for ordering them to ensure utmost sincerity & care in their works in the upcoming future along with proper & adequate maintenance of the previously built bridges so that the state of Bihar may not see any further demolition/ collapse of bridges in the upcoming time.

And/or (v) For issuance of any further order (s) / direction (s) or writ(s) which this Hon'ble Court may deem fit and proper in the facts and circumstances of the instant case."

2. Ordinarily in respect of entertaining Public Interest Litigation with certain directions to be issued to the concerned authorities. The petitioner is required to approach the concerned authority insofar as readdressing the grievance. In the event, of in action on the part of the official respondents, then only the petitioner has remedy of filing writ petition seeking Writ of Mandamus.

3. Perusal of the file, it is evident that the petitioner has not approached this Court without approaching the concerned authority. Accordingly, the present CWJC No. 9915 of 2024 stands disposed of. Reserving liberty to the petitioner to approach the concerned authority in respect of his grievance.

4. Respondents are requested to pass suitable order on the petitioner's representation or application if it is filed within a

4/4 period of three months from the date of receipt of such application. The present petition is de-linked from CWJC No. 8095 of 2025. CWJC No. 9915 of 2024 stands disposed of in the above terms.

5. Respondents are hereby directed to furnish complete documents along with supplementary affidavit filed on 22.09.2025 to the learned counsel for the petitioner within a period of one week from today.

6. The other official respondents if they have filed any counter affidavit or supplementary affidavit, the same shall be made available to the learned counsel for the petitioner within a period of one week.

7. The petitioner is also hereby directed to furnish if he has filed any supplementary affidavit to the other side within aforementioned time limit.

8. Relist this matter on 31.10.2025.
