KUMAR ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail inVaishali P.S. Case No.28 of 2010 instituted for the offence under Sections 363, 366(A)/34 of the Indian Penal Code.

Informant is the father of the victim girl who has lodged the F.I.R. on 8.2.2010 giving rise to Vaishali P.S.Case No.28 of 2010. As per her matriculation certificate as contained in Annexure-2 the girl was aged 16 years at the time of the alleged occurrence. The girl herself in her affidavit filed before the A.C.J.M., Hajipur, Vaishali, stated that she had gone with the petitioner on her own volition and got in nuptial bond with the petitioner on her sweet will and out of their wedlock one child was also born, namely, Apurv Rajak and at present he is aged about

Patna High Court Cr.Misc. No.48870 of 2017 (2) dt.17-10-2017 2/2 four years.

Considering the facts and circumstances of the case, let the petitioner , above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.-XII, Hajipur, Vaishali, in Vaishali P.S.Case No.28 of 2010.
