JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-06-2021 Heard Mr. Ranjeet Kumar Singh, learned counsel for the petitioner and Mr. Nand Kumar, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Bidupur PS Case No. 296/2019 registered for the offence punishable under Section 392 of the IPC.

The allegation, as per First Information Report, is that the informant was accosted by three miscreants who were riding on one motorcycle and on the gun point, they snatched the splendor motorcycle of the informant as well as a bag containing mobile and document etc.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and his name has transpired in this case on the basis of a

Patna High Court CR. MISC. No.2617 of 2021(3) dt.17-06-2021 2/3 confessional statement made by the petitioner himself recorded in another case bearing Bidupur PS Case No. 1120/2020 registered under Sections 399, 402, 413, 414 IPC and Section 25(1-b)a/26/35 of the Arms Act.

Learned counsel further submits that after arrest of the petitioner in the aforesaid case of Bidupur PS Case No. 1120/2020, he has been remanded in six other cases. Learned counsel next submits that no incriminating article or looted material has been recovered from the possession of the petitioner and he has not been put on TIP. Learned counsel also submits that the petitioner has been granted bail in all other cases and there is no likelihood that petitioner will abscond or tamper with the evidences, if he is released on bail. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 12.03.2020, charge-sheet has already been submitted in this case and there is no possibility that the petitioner will abscond or tamper with the evidences, if he is released on bail, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, AJEET KUMAR @ RANGDARWA @ GULLI be released on bail on furnishing bail

Patna High Court CR. MISC. No.2617 of 2021(3) dt.17-06-2021 3/3 bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur PS Case No. 296/2019.
