JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-11-2015 Heard learned counsel for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 354, 376, 379, 504, 511/34 of the Indian Penal Code.

It is alleged that the petitioners made an attempt to ravish the informant. When son of the informant came to rescue, they were also assaulted him. The accused persons snatched silver chain of the informant. It is submitted by the learned counsel for the petitioners that for the occurrence of 14.03.2011 the complaint was filed on 25.04.2011, which came to be registered as police case on 17.07.2014. There is no medical report on the record. It

Patna High Court Cr.Misc. No.51051 of 2015 (2) dt.09-11-2015 is further submitted that the informant has retracted from the initial version and filed a petition to that effect before learned court below. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Considering the delayed lodging of the case, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri Prasant Kumar Jha, Judicial Magistrate, Ist Class, Gaya in connection with Fatehpur P.S. Case No. 221 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
